I honestly think Altman can be guilty of being an inconsiderate asshole and have not broken any laws. Even if you take the fair use argument out of it, if it can be proved that Sky’s voice is based on another human being that consented to being recorded then I just don’t see the case. He could have tweeted @scarjo after the fact but that doesn’t make him guilty of breaking a law. Just being a prick.
According to Cornell, parody is protected under freedom of speech as long as it qualifies as fair use. Perhaps impersonating Johansson may not be considered fair use, but what about impersonating her robot movie character? https://www.law.cornell.edu/wex/parody
This is kind of murky now. If the model is based on another human being who consented to being modeled then I don’t see the case here. Even if the voice actress was told to purposely sound like Johansson it is still that other person’s voice.
Nobody is suing NBC for allowing Matt Friend to go on live TV and impersonate Trump, even though Trump never consented and those news segments are being monetized by commercials.
