    I’ve said it before and I’ll say it again:

    Shit like this needs immediate reaction.

    Biden refusing to take action against Texas is just emboldening them and other states.

    He needs to invoke title 10, ideally ued have done it as soon as the letter was released.

    It doesn’t matter what the law says if a significant amount of the guard refuse to acknowledge it.

    I don’t know how anyone can believe they’ll all just do the right thing, stop overestimating conservative nutjobs

        No, the asshats creating this mess in the first place (Abbott and the other Republican governors cheering him on) are the ones calling for Civil War. Let’s be clear about who is on what side here.

            •Court martial anyone who disobeys and send them to Leavenworth

            I did not say that. I merely pointed out that your previous comment was incorrect and that the user you responded to was not calling for Civil War. If you interpreted it as such, it’s because Abbott and the Republican governors hyping up (yet another) pointless dick measuring stunt are the ones who were quite literally mentioning Civil War as an option.

            That being said, however, I don’t give a fuck what Biden does here. This is a stupid non-issue. We have real, tangible problems he should be focusing on imo. But as far as the law goes, yeah, Biden can do whatever the fuck he wants in this instance. The national guard and immigration/border enforcement is reserved as a power of the federal government. He’s the chief executive and has the legal authority to wield that power as he sees fit within the bounds of the law.

              And I agree it’s a stupid non-issue, which is why I am pushing back against the “just call up the national guard and arrest everyone involved” opinion.

    Listen fash, you can apparently waste Florida taxpayer money in your performative bullshit as much as you want, but the second one of your goons impedes a federal officer, they are donezo & you won’t be able to do a damn thing to save them.

    U.S.C. 18: 111

    This statute outlines certain types of assault against a federal officer and the appropriate charges and penalties. Penalties for Assaulting or Resisting a Federal Officer A simple assault of a federal officer carries a $100,000 fine and up to one year in prison.

    For example, simple assault is forcibly assaulting, resisting, opposing, impeding, intimidating, or interfering with federal officers while performing their duties. As noted, physical contact or injury is not required for a conviction.

    Simple federal assault is a Class A misdemeanor that carries up to 1 year in jail and fines of up to $100,000.

    (b) Enhanced Penalty.—

    Whoever, in the commission of any acts described in subsection (a), uses a deadly or dangerous weapon (including a weapon intended to cause death or danger but that fails to do so by reason of a defective component) or inflicts bodily injury, shall be fined under this title or imprisoned not more than 20 years, or both.

    Florida can probably mostly do what it wants with its state guard, but Abbott is using the National Guard for this nonsense and their loyalty is to the president before the governor of the state of Texas. That is in their oath.

    I, ________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and of the State of ______ against all enemies, foreign and domestic; that I will bear true faith and allegiance to them; and that I will obey the orders of the President of the United States and the Governor of ______ and the orders of the officers appointed over me, according to law and regulations.       Yes, exactly this.

      The National Guard belongs to the respective DOD branch and can be activated for federal duty by order of the President of the United States. Failure on the part of leadership or members to do that will have extremely negative consequences - the end of a military career and likely jail time in a very unpleasant prison. As part of the US military, they are part of a large organization which will enforce consequences. It’s not something trivial.

      Abbott can use state troopers or Texas rangers or whatever, but if Biden orders the Texas National Guard into federal service, then Abbott and the Texas police will be put into a position of facing the US Army.

      Florida has its own “guard” unit in additional to the Florida National Guard because DeSantis wanted brown shirts, but again they’d have to think it’s an important enough issue to face the US Army, and the group is really just a private DeSantis Proud Boys unit.

    Giallombardo said if the bill passed the Florida State Guard would only be deployed to other states based on mutual agreement, commenting: “They can’t just send [the guard] into somebody else’s state without the state asking or the state knowing.”

    Translation: we have to normalize the concept a couple times first before we do the thing we explicitly said we wouldn’t.

    Governor Babbott wants the state guards to be able to shoot migrants at will. I guess just murdering kids by letting them get skewered with razor wire and drown isn’t fast enough for him.

    The time is quickly approaching when Texas will be firing on migrants and killing them without mercy right left and sideways. Mark my words.

    This is absolutely not what Trump wants even if his fans do because Trump wants to brag about winning the election and fomenting some sort of national insurrection before the election is not going to get him those bragging rights.

    And Trump lives for bragging rights.
